The Deputy Branch Director helps provide oversight of and coordinates the Federal Programs Branch litigation activities and programs, especially those involving national security and foreign relations. The incumbent provides critical supervision of and guidance to attorneys and support staff, who handle a broad range of challenges to policies and actions relating to the defense and foreign policy of the United States; these litigation matters include, among others, a full range of constitutional, statutory, and regulatory challenges. Defense of these actions involves representation of agencies and officials (in their official capacities) of the Department of Defense and military services, elements of the Intelligence Community, the Department of State, the Department of Justice and Federal Bureau of Investigation, the Department of Homeland Security, the Treasury Department, and the White House. One of the main objectives in defending these suits is to protect the constitutional prerogatives of the Executive Branch in the areas of national security and foreign policy. In addition to managing attorneys and office staff, the incumbent works closely with others in management and with officials at senior levels of the Department, in client agencies, and in the U.S. Attorneys Offices. The incumbent also analyzes and reviews proposed and pending legislation that may affect the office's areas of expertise. The incumbent also assists the Branch Directors in setting litigation and resource-allocation priorities for the Federal Programs Branch. And the Deputy Director may be expected to handle some of the office's high-stakes litigation, arguing major cases in court and conducting negotiations with opposing parties in sensitive situations. Finally, as determined by the Branch Directors, the Deputy Director may be required to handle such administrative responsibilities of the Branch as may be needed.

The Civil Division is the largest litigating division in the Department of Justice. Each year, the Civil Division's 1,100 lawyers represent some 200 client agencies in approximately 50,000 different matters. The Civil Division of the U.S. Department of Justice is looking for an individual to serve as a Senior Executive Deputy Director in its Federal Programs Branch. The activities of this Branch include defending against constitutional challenges to Federal statutes; suits to overturn Government policies and programs; attacks on the legality of Government decisions; and representation of the United States' interests in third party matters. These cases typically seek injunctive and declaratory relief against the Government, and vary from suits involving the personnel practices and policies of the Government to matters involving the national security. The Branch also initiates litigation to enforce regulatory statutes and to remedy statutory and regulatory violations.
