The Regional Office responsibility for the trial in U.S. District Courts and before administrative law judges of all civil litigation under the Fair Labor Standards Act, Mine Safety and Health Act, Occupational Safety and Health Act, Black Lung Benefits Act, the Employment Retirement Income Security Act, Family and Medical Leave Act, Public Contracts Act, Section 503 of the Rehabilitation Act, and over 180 diverse federal laws enforced by the Department of Labor's agencies. Legal advisory services are also furnished in connection with many of these Acts and Executive Orders. Legal advice and assistance is also given to the Office of the United States Attorney in regards to the criminal prosecution of cases and defensive actions under such statutes as the Fair Labor Standards Act, Labor-Management Reporting and Disclosure Act, Mine Safety and Health Act, Occupational Safety and Health Act and other federal statutes and Executive Orders. This office is responsible for legal advice and litigation under various whistleblower statutes. This office represents the various agencies in adverse action matters before the Merit Systems Protection Board and the Equal Employment Opportunity Commission.
Duties:
Responsible for the direction and conduct of litigation and other legal work involved in the enforcement of labor statutes in the states of Alaska, Arizona, California, Hawaii, Idaho, Nevada, Oregon, and Washington, as well the Pacific Island territories of the United States, under one or more of the following statutes and program areas: Fair Labor Standards Act, Mine Safety and Health Act, Occupational Safety and Health Act, Black Lung Benefits Act, the Employment Retirement Income Security Act, Family and Medical Leave Act, the Service Contract Act; the Contract Work Hours and Safety Standards Act; the Davis Bacon Act; the Longshore and Harbor Workers Compensation Act; the Migrant and Seasonal Agricultural Worker Protection Act; the Civil Service Reform Act; Executive Order 11246, among others; and Title VII of the Civil Rights Act.
At the direction of the Regional Solicitor, Associate Regional Solicitor, Deputy Regional Solicitor, or program counsel, the employee advises, counsels, and works with the various Regional Department of Labor agencies in representing the Secretary of Labor. Assigned important legal cases arising within the Region, often involving complex and difficult factual, procedural, substantive, and administrative issues that potentially have an effect on positions taken by the agency heads on programmatic enforcement both regionally and nationally, and often have a substantial impact on one or more particular industries. The cases routinely involve extensive research, analysis, and use of expert testimony in controversial and highly technical areas in the scientific, medical, financial, statistical, and engineering fields. The cases frequently involve large sums of money, multi-establishment employers with large numbers of employees, important enforcement policies, and novel issues.
May also be responsible for litigating delicate matters in which the government has assumed a heavy burden of proof and/or cases where there has been media attention or interest from members of Congress.
Handles cases that are vigorously opposed by senior legal counsel employed by labor law sections of national law firms or otherwise highly qualified and very experienced litigation counsel. Some of these cases are of such scope and complexity that they require the assistance and concentrated efforts of one or more attorneys of lower grade. In such circumstances, in consultation with the supervising attorney, may be responsible for directing, coordinating, and reviewing the work of other trial team members and for the overall development and presentation of the case.
Handles defensive Labor Management Relations work for advice and litigation within assigned region.
The duties above are at the full performance level (GS 14). If selected at the lower level (GS 12 and GS 13), selectee will perform similar duties with varying levels of supervision.

To qualify for an attorney position, applicants must possess a professional law degree (LL.B. or J.D.); be a member in good standing of the bar of a court of general jurisdiction of a state, territory or possession of the U.S.; and have acquired the amount of experience indicated below for each grade level.
GS-12: At least one (1) year of progressively responsible legal experience of a professional nature which demonstrates the ability perform work at this level.
GS-13: At least two (2) years of progressively responsible legal experience of a professional nature which demonstrates the ability to perform work at this level.
GS-14: At least three (3) years of progressively responsible legal experience of a professional nature which demonstrates the ability to perform work at this level. At least one year of the one (1) year of qualifying experience, at this level must be specialized experience as defined below.
Specialized experience is defined as experience conducting federal or administrative litigation (involving federal laws), which includes developing case strategy; drafting initial pleadings and motions; conducting written discovery and deposition practice; preparing for trial; and trial.
