NSLS attorneys perform a crucial role in ICE's overall efforts to protect the national security of the United States in cases involving international terrorism, counter terrorism, espionage, and other national security matters.
ICE OPLA is seeking an attorney(s) for its headquarters office in Washington, D.C. The primary duties will be to provide legal advice and counsel regarding regulations, executive orders, legislative proposals, and interpretation of the immigration laws that affect the Homeland Security Investigations (HSI) Student and Exchange Visitor Program (SEVP) as well as other ICE programs. The position requires knowledge of administrative law and the protections extended to regulated entities under the Administrative Procedure Act (APA). The attorney will provide guidance and legal review of actions regarding the licensing and certification of regulated entities; draft and review regulations and policies; and advise on whether particular initiatives must be implemented through notice-and-comment rulemaking or less formal procedures. The attorney will also develop and provide legal training to SEVP adjudicators, HSI agents, and operational personnel on matters of school and student regulatory compliance. Competitive applicants will have experience with administrative enforcement actions, APA compliance, regulatory drafting, strong organizational skills, and the ability to collaborate effectively to implement agency initiatives through regulations and policies.
In addition to these primary duties, the attorney may be responsible for national security-related work on issues, including, but not limited to: providing national oversight of, and litigation support to, OPLA field locations in their litigation of national security issues before the Executive Office for Immigration Review; working with the Federal Bureau of Investigation, the Central Intelligence Agency, and the Department of State, as well as the National Security, Civil, and Criminal Divisions of the Department of Justice on national security matters; coordinating removal proceedings and supporting criminal prosecutions involving terrorists, foreign intelligence agents, and other national security matters; drafting briefing papers and Congressional testimony for DHS, ICE, and OPLA leadership; analyzing and drafting legislative proposals that affect national security; and providing well-reasoned legal and policy advice regarding immigration, intelligence and customs issues relating to national security.
The position is within the ICE OPLA National Security Law Division (NSLD), a team of approximately 17 attorneys, which provides legal advice to ICE Enforcement and Removal Operations (ERO) and HSI officers, agents, and senior management. NSLD's work contributes to significant policy decisions that are integral to ICE's overall mission. Assignments within NSLD are typically fast-paced and involve high-profile work. NSLD attorneys are responsible for advising, counseling, and training ICE officers and agents on relevant legal authorities, best practices, and agency policies.
The selected attorney will immediately be given significant responsibilities. He or she will be expected to craft and adapt legally supportable policies to address the pressing needs of the agency and its operational components. The attorney will be expected to routinely provide timely legal opinions to ICE officers and agents, NSLD management, and leadership within OPLA, ICE, and the Department of Homeland Security's Office of the General Counsel Headquarters. The selected attorney will be required to assess litigation risk and provide litigation support to the Department of Justice.

The selectee must be able to obtain a security clearance at the Top Secret/Sensitive Compartmented Information level.

Promotion Potential: This position may be filled at the GS-12, GS-13, or GS-14 grade level. If a selection is made at either grade level, promotion to the next higher level is without further competition. This position has full promotion potential to the GS-0905-15. When promotion potential is shown, the agency is not making a commitment and is not obligated to provide future promotions to you if you are selected. Future promotions will be dependent on your ability to perform the duties at a higher level, the continuing need for an employee assigned to the higher level, and administrative approval.
Trial Period: New attorneys to the Federal government will be required to serve a trial period of 2 years.
