Candidates must be an attorney in good standing with at least seven (7) years of legal experience and must have at least five (5) years of experience in adjudication, arbitration, or court trials.
The Chief Copyright Royalty Judge has overall responsibilities and delegated authority for the oversight and administration of broad, emerging, and or critical Library of Congress program or operations as related to quasi-judicial administrative proceedings for copyright royalties. Also, the incumbent has full responsibilities and duties assigned to the Chief Copyright Royalty Judge pursuant to Chapter 8, Title 17 of the United States Code (H.R. 1417).
Certain tasks described herein shall be performed in collaboration with the other Copyright Royalty Judges, or at the direction of the Chief Copyright Royalty Judge when appropriate.
Has overall responsibility, as well as delegated authority, for the oversight and administration of broad, emerging, and/or critical agency programs or operations in the area of quasi-judicial administrative proceedings for copyright royalties. Carries out all the responsibilities assigned to the Chief Copyright Royalty Judge in Chapter 8 of title 17, United States Code.
Conducts and oversees quasi-judicial administrative proceedings to set and adjust terms and rates of royalty payments for the compulsory and statutory licenses in the Copyright Act, title 17 of the United States Code. Conducts and oversees quasi-judicial administrative proceedings to determine the distribution of royalty fees collected under sections 111, 119 and 1005 of the Copyright Act.
Conducts legal research and prepares probing and innovative written legal analyses with respect to legal and factual issues to define or clarify controversial or disputed legal issues; apply sophisticated legal analysis to intractable problems; and assess legal and institutional constraints. Applies a comprehensive knowledge of a range of specialized areas of the law to the development, interpretation, or implementation of sensitive public policies that have long-range national or international significance. Makes final determination on legal and factual questions. Prepares and issues final determinations within the statutory time limits announcing new royalty rates or a final distribution of copyright royalties, and insures that the determination is published in the Federal Register.
Evaluates evidence, and interprets testimony, regulations, statutory provisions regarding standards for setting rates and making distributions, and past precedents. Makes final determination on certain legal and factual issues. Schedules proceedings, rules on motions and admissibility of evidence according to the rules governing these proceedings, administers oaths and examines witnesses, issues subpoenas, maintains order, makes procedural rulings, and schedules settlement conferences.
Performs the human resource management functions relative to the staff supervised. Establishes performance expectations for staff members, which are clearly communicated. Provides informal feedback and periodically evaluates staff on organizational performance. Resolves informal complaints and grievances. Takes personnel actions as necessary. Provides personnel advice and counsel to staff members and subordinate managers related to work and policy matters. Effects disciplinary measures. Reviews and approves or disapproves leave requests. Assures that organization staff at all levels is trained and fully complies with the provisions of the safety regulations.
Serves as an expert on legal and factual matters on quasi-judicial administrative proceedings in the area of statutory copyright royalties. Informs senior management staff and officials at multiple levels of the Library of Congress and the Copyright Office on matters related to copyright royalty distributions and rate settings.
Establishes and maintains effective working relationships with various high-level individuals in LOC, the Copyright Office, and the Department of Justice. Establishes and maintains cooperative working relationships with Library of Congress management and officials, representatives from government agencies, and other institutions with related interests, in order to advance the oversight of quasi-judicial administrative proceedings in the area of copyright royalties.

Although the Library of Congress is not covered by the nationwide injunction against the federal government vaccine requirement, the Library of Congress has decided it will not enforce its vaccine requirement at this time.
